Preamble
Please read the General Terms and Conditions carefully before placing an order.
These general sales conditions relate to the use of the online store of the company Bargot World Ltd., Belgrade-Zemun, headquartered at Emilije Jakšić 1, registration number 21766500, VAT number: 112911883, email address for receiving electronic mail office@bargotworld.com (hereinafter: Seller) via the website: www.bargotworld.com (hereinafter: Website).
The General Terms and Conditions govern the relationship between the Seller, the provider of e-commerce services on www.bargotworld.com, and you, our customer, and they constitute an integral part of each sales contract concluded in electronic form.
We apply the same approach conscientiously to all our customers and provide the same benefits, regardless of whether they are our users or not. Therefore, the rules established in these General Terms and Conditions will apply to and bind all our customers.
These General Terms and Conditions relate to the purchase of products in our e-store (through our website).
By accessing the Website, the customer confirms that they are familiar with the provisions of these General Terms and fully agree with them.
These General Terms apply to each individual access by each individual Customer.
The customer confirms that they are of legal age or, with parental permission, accept all the terms that the Seller has posted on the Website, or that they are legally capable of concluding a contract and placing an order through the Website.
Validity of rules
The Seller has the right, at any time, if deemed necessary, to terminate or modify any of the sales conditions listed here, which modification will take effect immediately upon their publication on the Website.
By continuing to use the Website after the modified conditions, it is considered that the customer agrees with them and that the Seller will not be responsible for any possible consequences resulting from the changes.
If you do not agree with the changes, please do not use the Website and contact the Seller via email: office@bargotworld.com or by phone +381 67 7227 468, so that we can delete your data.
Sales contract
The sales contract can be concluded through e-commerce.
The contract can be concluded in Serbian and English by choosing the language option.
By ordering and sending the order through our website or with the help of Customer Service, a proposal for a sales contract is created.
The order will be processed within a period of up to 3 days, while the order confirmation will be sent to your email.
The sales contract is considered concluded at the moment when the offeror receives an electronic message containing the buyer’s statement accepting the offer, and the offeror confirms receipt of the acceptance of the offer with a separate electronic message to the buyer.
The sales contract will then be executed by sending the ordered items. You will be informed about the shipment of the package via email.
The contract will be concluded in the Republic of Serbia and will be governed by the laws of the Republic of Serbia.
Ordering Goods
The customer can order goods directly through the Website as an unregistered user or after registration has been completed. All purchases by registered customers are recorded, so the registered customer will eventually be entitled to various benefits for future orders.
The customer is responsible for the accuracy and completeness of the information entered during registration.
If there are any changes to the data entered during registration, the customer is obliged to update their user account as soon as possible or inform the Seller of the changes via email: office@bargotworld.com.
Goods are ordered electronically by clicking the Add to Cart option, which adds the selected product to the customer’s cart.
The customer chooses the delivery method and selects the method of payment for the goods.
The Seller reserves the right to, considering technical limitations related to real-time inventory tracking, display the price of an item on the Website even if it is not currently in stock, so the Seller does not guarantee the availability of stock at all times. The product inventory status is updated once every 24 hours, so it may happen that you order a product that has been sold out in the meantime. If this happens, you will be promptly notified.
Price
The Seller independently determines the prices of the Goods in accordance with its business policy and reserves the right to change the advertised prices.
In accordance with the law, all prices listed include the applicable VAT, but do not include the costs of delivering the Goods to the customer, which are charged additionally, except for Goods for which it is explicitly indicated that delivery is free.
The advertised prices of products and services are shown with the VAT applicable at the time of ordering. In the event that the VAT rate changes before the conclusion of the sales contract or before the shipment of the goods, the customer is obliged, considering the selected method of payment, to settle any difference in the purchase price, or the Seller will promptly verify with the customer whether they can charge more than the purchase price via email.
All advertised prices, including discounted prices, are valid until further notice or until stocks are exhausted.
Payment for Goods and Delivery of Goods
You can choose the method of payment and delivery yourself. Before sending the order, you will be informed about the selected method of payment and delivery, as well as the delivery costs.
You can view the payment and delivery methods we provide, as well as the delivery cost, here.
Protection of Confidential Transaction Data
When entering credit card data, confidential information is transmitted over a public network in a protected (encrypted) form using SSL protocol and PKI system, as the currently most advanced cryptographic technology. The security of data during the purchase is guaranteed by the payment card processor, Banca Intesa ad Belgrade, so the complete payment process is carried out on the bank’s pages. At no time are credit card data available to our system.
Conversion Statement
All payments will be made in the local currency of the Republic of Serbia – Serbian Dinar (RSD). The amount that will be charged to your payment card will be expressed in your local currency through conversion at the rate used by card organizations, which cannot be known to us at the time of the transaction. As a result of this conversion, there is a possibility of a slight difference from the original price listed on our website.
Complaints and Returns of Goods
The customer has the right to file a complaint with the seller by email: office@bargotworld.com or in writing to the address Bargot World doo, Emilije Jakšić 1, 11 080 Belgrade-Zemun, by filling out the form that you can download here, in the following cases:
- delivery of goods that do not conform to the ordered goods;
- delivery of goods that have defects or damages not caused in transport;
- delivery of goods that were not ordered.
All complaints are subject to the valid Seller’s Complaints Policy and Consumer Protection Law.
The customer is obliged to immediately inspect the delivered goods upon receipt and to inform the carrier of any possible defects immediately.
In the event of returning goods and refunding funds to a customer who has previously paid with a credit card, partially or in full, regardless of the reason for the return, the seller is obliged to make the refund exclusively via VISA, EC/MC, and Maestro payment methods, which means that the bank, at the seller’s request, will refund the funds to the cardholder’s account.
Withdrawal from Distance Contracts concluded via the Internet
The buyer has the right to unilaterally terminate the sales contract, regardless of the reasons, within 14 days from the day the Goods are delivered to the address indicated by the buyer, under the following conditions:
- the Goods being returned are undamaged, unopened, and unused;
- no more than 14 days have passed since the delivery of the Goods to the Buyer (counting non-working days);
- the buyer has filled out and sent the Seller the Form for unilateral termination (you can download the form here) to the following email address: office@bargotworld.com;
- the Seller has confirmed receipt of the Form for unilateral termination;
- the buyer has packaged the Goods for transport in a way that prevents damage during transport;
- the buyer has enclosed the documentation provided to the Buyer upon delivery (cash receipt, delivery note, etc.);
- the buyer bears the direct costs of returning the Goods;
- the Seller has confirmed receipt of the shipment that meets the conditions for a refund.
The address to which the buyer is obliged to return the Goods without delay is Bargot World doo., headquartered at Emilije Jakšić 1, 11080 Belgrade-Zemun.
If the seller, as part of the concluded contract, sends an additional product to the buyer for free (“gift” or tester), that product must also be returned. In this case, you bear the cost of returning the goods.
Within 14 days of receiving the Form for unilateral termination, the Seller will refund the amount paid by transferring it to the account specified by the buyer in the Form for unilateral termination, with the right to extend the payment deadline until the Seller receives the Goods returned by the buyer.
Exceptionally, the seller is not obliged to refund additional costs resulting from the explicit request of the consumer for delivery that deviates from the cheapest usual delivery offered by the merchant.
The buyer does not have the right to withdraw from the contract in the following cases:
- provision of services, after the service has been fully performed if the provision of the service began with the express prior consent of the consumer and with his confirmation that he is aware that he loses the right to withdraw from the contract when the merchant fully performs the contract;
- delivery of goods or provision of services whose price depends on changes in the financial market that the trader cannot influence and that may occur during the withdrawal period;
- delivery of goods made to the consumer’s specifications or clearly personalized;
- delivery of goods liable to deteriorate or expire rapidly;
- delivery of sealed goods that cannot be returned for reasons of health protection or hygiene and that have been unsealed after delivery;
- delivery of goods that, by their nature, are inseparably mixed with other items after delivery;
Please note that, according to the law, you are responsible for any decrease in the value of the goods as a result of handling the goods in a manner other than necessary to acquaint yourself with the nature, characteristics, and functioning of the goods (for example, if you continue to use perfume after trying it). Additionally, please note that you do not have the right to withdraw from the purchase contract in the case of goods produced according to your specific requirements or personalized and customized goods (for example, engraving a personal name or packaging with a personalized dedication) and goods that have been removed from the packaging and cannot be returned in the same packaging for hygiene reasons (open cosmetic products and other products that come into direct contact with the skin).
The obligations of the seller and the rights of the buyer regarding the delivery under the sales contract concluded at a distance or outside the business premises are subject to the provisions of the Law ensuring consumer protection in exercising rights under the sales contract.
Out-of-Court Dispute Resolution
The buyer has the right to settle their dispute out of court if they previously file a complaint or claim to the Seller in accordance with the Consumer Protection Act.
In such a case, the Seller is obliged to participate in the out-of-court procedure before the body for consumer dispute resolution if the consumer submits a proposal for such resolution within one year from the date of filing the complaint with the merchant.
According to the Consumer Protection Act, the body for out-of-court resolution of consumer disputes is a natural person engaged in mediation and registered in the register of bodies maintained by the Ministry.
The procedure is initiated by the consumer’s proposal, which is submitted to the Ministry of Trade, Tourism, and Telecommunications, directly, by mail, or electronically.
Each party in the out-of-court consumer dispute resolution process bears its own costs (representation costs, travel expenses, etc.).
The consumer may withdraw from further participation in the out-of-court resolution of the consumer dispute until the procedure is completed.
Non-delivery of Goods
The Seller reserves the right not to deliver an order at any time if there is suspicion of abuse or violation of any of the General Terms and Conditions. Suspicion of abuse or violation of any of the General Terms and Conditions or other rules posted on the Website entails deleting the Buyer from the Seller’s database and preventing new orders. Additionally, the Seller reserves the right not to deliver orders at any time if there is suspicion indicating that the delivery of goods could jeopardize the physical or mental integrity of the individuals performing the delivery of the Goods.
Miscellaneous
We strive to provide our customers with discounts and gifts. In each individual case, we will inform the customer about current discounts or gifts. Unless otherwise stated, each discount or gift voucher can only be used once. Discounts cannot be combined unless otherwise specified.
Regardless of registration in the do-not-call registry for consumers who do not wish to receive calls and/or messages as part of telephone promotion and/or sales, the consumer’s consent for direct advertising given to the merchant before or after registration in the registry remains valid until revoked in accordance with the Personal Data Protection Law.
Sending Free Samples
We offer our customers the service of sending free samples. We reserve the right to offer you the possibility of receiving a free shipment of perfume and other cosmetic product samples depending on the current offer for the purpose of trying out the products we offer.
The choice of free samples is limited by our stock and current offer.
The purpose of the free sample delivery service is to inform the customer about the current offer. Sending free samples is a free advertising service and is not subject to the performance within the sales contract. Therefore, disagreement with the sent sample is not a reason to terminate the sales contract or return the goods.
Any product, service, or sample we provide you with is for your personal use. You cannot resell any product you receive from us.
